Different Types of Custody
Sole Custody: A fairly well-known term, sole custody refers to sole physical custody and decision-making capabilities that are conferred to one parent. This often occurs when the parties cannot cooperate or one party fails to recognize the problems that he or she has, or the problems of the child.
Joint Custody: Joint custody is akin to joint parenting, as it has little to do with physical residency but more with joint decision-making regarding topics such as health care, education and religion.
Joint Physical Custody: Children that split their time between two parents' homes are considered to be under a joint physical custody order.
Visitation: When a parent has no custodial rights, or isn't granted any for some reason, they may be granted visitation. This allows the parent alone or supervised time with the child in order to maintain a relationship.
Modification of Child Custody Orders
Any time a parent experiences a drastic change in their circumstances, such as the loss of a job, it is important to see that any child custody order modifications go through the proper channels. If they do not go back through the courts where they were established, a parent may be held responsible for violating the order and have their custody or visitation rights altered.
Relocation
If a parent wishes to move out of state with a child, a modification must be made to the child custody order.
